Other terms that may apply

Our privacy policy explains how we use any personal information you give us, and also applies to your use of this website.

These terms cover your use of the website only. Production commissions, footage licences, footage acquisitions and equipment hire are each governed by a separate written agreement between you and us. If there is any conflict between these terms and one of those agreements, the agreement will apply.

Changes to these terms and to the website

We may update these terms from time to time, for example to reflect changes in the law or in our business. The date at the top of this page shows when they were last changed. Please check this page each time you use the website.

We may update, suspend or withdraw the website, or any part of it, at any time. We do not guarantee that the website will always be available or uninterrupted, and we will not be liable to you if it is unavailable for any period.

Using the website

You may use the website for lawful purposes only. You must not:

  • use the website in any way that breaks any applicable law or regulation, or that is fraudulent or harmful;
  • attempt to gain unauthorised access to the website, the server it is stored on or any connected system;
  • knowingly introduce viruses, malware or any other material that is malicious or technologically harmful;
  • attack the website through a denial-of-service attack or any similar method;
  • copy, scrape or harvest content from the website by automated means for any commercial purpose.

Breaking these rules may also be a criminal offence under the Computer Misuse Act 1990. We may report any such breach to the relevant law enforcement authorities and cooperate with them, including by disclosing your identity to them.

Intellectual property

We own, or are licensed to use, all intellectual property rights in the website and its content, including text, design, graphics, code, logos, film stills and footage. These works are protected by copyright and other laws around the world, and all rights are reserved.

You may view the website and print or download extracts for your own reference, including for internal business use when considering working with us. You must not otherwise copy, adapt, distribute or use any part of the content, and you must not use any footage or imagery from the website in any production, broadcast or publication without first obtaining a licence from us.

Our status, and that of any identified contributors, as the authors of content on the website must always be acknowledged.

Information on the website

The content on the website is provided for general information only. It is not intended to amount to advice or to an offer capable of acceptance. Descriptions of our services, footage and equipment are given in good faith, but availability, specifications and pricing must be confirmed with us in writing before you rely on them.

We make reasonable efforts to keep the website accurate and up to date, but we make no representations, warranties or guarantees, whether express or implied, that the content is accurate, complete or current.

Ideas, pitches and footage you send us

We welcome pitches, proposals and footage. When you send them to us:

  • you confirm that you are entitled to share the material with us, and that doing so does not infringe anyone else's rights;
  • you remain the owner of your material unless and until we agree otherwise in a signed written agreement;
  • we will treat material you send us with reasonable care and use it only to evaluate it and respond to you;
  • you understand that we receive many ideas and may already be developing, or later develop, projects that are similar to yours independently, and that sending us an idea does not by itself create any obligation on us to use it, pay for it or credit you for it.

Please send links to footage rather than large file attachments, and do not send original or only copies of any material.

Our responsibility for loss or damage

Whether you are a consumer or a business

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, and for fraud or fraudulent misrepresentation.

If you are a business

To the extent permitted by law, we exclude all implied conditions, warranties, representations or other terms that may apply to the website or any of its content. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising under or in connection with your use of, or inability to use, the website, or your use of or reliance on any content on it. In particular, we will not be liable for loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation, or any indirect or consequential loss or damage.

If you are a consumer

We only provide the website for domestic and private use. You agree not to use it for any commercial or business purpose, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

If defective digital content that we have supplied damages a device or digital content belonging to you, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge, or for damage caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.

Viruses

We take reasonable steps to keep the website secure, but we do not guarantee that it will be free from bugs or viruses. You are responsible for configuring your own technology to access the website, and you should use your own virus protection software.

Links to other websites

Where the website contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those websites or any information you may obtain from them. We have no control over the contents of those sites or resources.

Linking to our website

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists, and you must not frame the website on any other site.

Which country's laws apply

If you are a consumer, these terms, their subject matter and their formation are governed by the law of England and Wales. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction, except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland you may also bring proceedings in Scotland.

If you are a business, these terms, their subject matter and their formation, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are governed by the law of England and Wales, and the courts of England and Wales will have exclusive jurisdiction.
